The contract is between Sunkazy (the seller) and the customer (any individual or entity placing an order through our website). By completing a purchase, you confirm that you have read, understood, and accepted these Terms.

1.3 Eligibility

To use our website and place an order, you must be at least 18 years of age, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract. By using our website, you represent and warrant that you meet these requirements.

1.4 Geographic Restrictions

Sunkazy does not offer products or services to customers located in regions subject to international trade sanctions, export control restrictions, or where the sale of our products is otherwise prohibited by applicable law. This includes, but is not limited to, countries or territories sanctioned by the United Nations, the United States Office of Foreign Assets Control (OFAC), the European Union, or other relevant regulatory bodies. By placing an order, you confirm that you are not located in, or acting on behalf of any person or entity in, a restricted region. We reserve the right to cancel and refund any order that we determine, at our sole discretion, violates this restriction.

2. Products and Services

2.1 Product Descriptions

We make every effort to display our products as accurately as possible. However, product images, colors, and descriptions on our website are for illustrative purposes only and may vary slightly from the actual product due to photography, screen settings, or manufacturing tolerances.

2.2 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. If a product you have ordered becomes unavailable after your order is placed, we will notify you promptly and offer a full refund or an alternative product.

2.3 Customized or Personalized Products

Where products are made to order or personalized according to your specifications, these items may not be eligible for return or cancellation once production has commenced, except in cases of defect or error on our part.

3.1 Prices

All prices are displayed in USD and are inclusive of any applicable taxes unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders that have already been confirmed.

3.2 Shipping Fees

Shipping fees are calculated at checkout based on your delivery address and selected shipping method. Free shipping promotions, where applicable, will be clearly indicated on our website.

3.3 Accepted Payment Methods

We accept the following payment methods: Visa, Mastercard, American Express, PayPal, and Shop Pay. All payment information is encrypted and processed securely. We do not store your full card details.

3.4 When Payment Is Charged

3.5 Customs and Import Duties

For international orders, customs duties, import taxes, and other fees may be levied by your country's customs authority. These charges are the sole responsibility of the customer and are not included in our product prices or shipping fees.

4. Ordering Process

4.1 How to Place an Order

Select your desired products, add them to your cart, and proceed to checkout. You will be asked to provide your shipping address and payment details. Please review your order carefully before confirming.

4.2 Order Confirmation and Contract Formation

A binding contract between you and Sunkazy is formed when you receive an order confirmation email from us. This email constitutes our acceptance of your order. We reserve the right to decline any order prior to sending this confirmation.

4.3 Right to Refuse or Cancel Orders

We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, product unavailability, or orders from restricted regions. If we cancel your order, you will receive a full refund to your original payment method.

5. Right of Withdrawal (Cooling-Off Period)

5.1 Your Right to Cancel

If you are a consumer, you have the right to withdraw from your purchase without giving any reason within 14 days of the date on which you (or a third party you designate) receive the goods. This is commonly referred to as the cooling-off period.

5.2 How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, you must notify us of your decision by sending a clear written statement to hello@sunkazy.com before the 14-day period expires. You may use the following model withdrawal statement:

"I hereby give notice that I withdraw from my contract of sale of the following goods: [product name(s)], ordered on [date], received on [date]. Name: [your name]. Address: [your address]. Date: [date]."

5.3 Effects of Withdrawal

Upon valid withdrawal, we will reimburse all payments received from you, including standard delivery costs (but not any additional costs arising from your choice of a delivery method other than our standard option), without undue delay and no later than 14 days from the day we receive your withdrawal notice or the returned goods, whichever is earlier. Refunds will be made using the same payment method you used for the original transaction.

5.4 Return of Goods

You must return the goods to us without undue delay and no later than 14 days after notifying us of your withdrawal. You will bear the direct cost of returning the goods unless the item is defective or incorrect. Goods must be returned in their original condition and packaging.

5.5 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to: goods made to your specifications or clearly personalized; sealed goods not suitable for return due to health or hygiene reasons that were unsealed after delivery (e.g., certain jewelry items); or goods that have been used, damaged, or are not in their original condition.

6. Complaints and Warranties

6.1 How to Submit a Complaint

If you are not satisfied with your purchase or have a complaint, please contact our customer service team at hello@sunkazy.com within 30 days of receiving your order. Please include your order number, a description of the issue, and supporting photographs where applicable. We aim to acknowledge all complaints within 2 business days and resolve them within 14 business days.

6.2 Defective or Non-Conforming Goods

If you receive a product that is defective, damaged in transit, or does not conform to the description on our website, you are entitled to one of the following remedies at our discretion: repair of the defective item; replacement with an identical or equivalent product; or a full or partial refund to your original payment method. Please notify us within 7 days of receiving a defective or incorrect item. We may request photographic evidence before processing your claim.

6.3 Warranty

Our products are warranted to be free from defects in materials and workmanship under normal use for a period of 30 days from the date of delivery. This warranty does not cover damage caused by misuse, accidents, unauthorized modifications, or normal wear and tear.

6.4 Consumer Statutory Rights

Nothing in these Terms limits or excludes your statutory rights as a consumer under applicable law. If any provision of these Terms conflicts with your statutory rights, your statutory rights shall prevail.

9.2 Exclusion of Indirect Losses

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of our website or products.

9.3 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, government actions, strikes, or disruptions to postal or courier services. We will notify you as soon as reasonably practicable and will endeavor to resume performance as soon as possible.

10. Dispute Resolution

10.1 Governing Law

These Terms of Service and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions, as this is the jurisdiction in which Sunkazy's registered company (KINGSWELL S.R.L.) is incorporated.

10.2 Jurisdiction

Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Romania.

10.3 Alternative Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us at hello@sunkazy.com to attempt to resolve any dispute informally. We are committed to working with you in good faith to reach a fair resolution. If informal resolution is not possible, you may also seek assistance from a recognized consumer dispute resolution body in your jurisdiction.
